INTERNAL DIRECTIVE AND CONSENT FORM

 

To MTEK BİLİŞİM SİSTEMLERİ VE DANIŞMANLIK HİZ.SAN.TİC.A.Ş (“Company”),

In accordance with the Law No. 6698 on the Protection of Personal Data (“Law”) dated 07 April 2016, as amended from time to time, as the data controller, certain responsibilities and obligations are assumed within the scope of the Law.

With this internal directive text, the Company wishes to inform its employees about the scope and purpose of processing the personal data of employees within the Company and the rights of its employees arising from the Law. We would like to point out that our Company is very sensitive about the protection and confidentiality of its employees’ personal data.

 

Article 1. Processed Personal Data

1.1. The Company complies with this Internal Directive regarding the processing of the following personal data:

1.1.5. Date of Birth and Place

Article 2. Purpose of Processing Your Personal Data

2.1. The purpose of processing the personal data of our company’s employees, including health data, is as follows:

2.1.1. Ensuring the establishment and execution of the service contract,

2.1.2. To ensure that our company fulfills its legal obligations,

2.1.3. To fulfill our company’s obligations arising from the law and social insurance legislation as an employer,

2.1.4. To ensure that our Company’s legally legitimate interests are fulfilled, to the extent necessary,

2.1.5. To ensure the operation and order of the workplace.

 

Article 3. Processing of Your Personal Data

3.1. All forms, petitions, documents and documents submitted to the Company by you, as employees, are processed by the Company.

3.2. Devices such as computers and phones allocated or given to employees by the company for business purposes must be used for their intended purpose. Any personal data transmitted to the Company through these tools is stored and processed by the Company. However, when processing employee personal data, the Company always takes care to respect employee fundamental rights and freedoms and does not prejudice the privacy of private life.

 

Article 4. Sharing of Your Personal Data

4.1. The company shares the personal data of its employees, including health data, with third parties when necessary. The personal data in question can also be shared with public institutions and organizations upon request.

 

Article 5. Transfer of Your Personal Data

5.1. Your personal data held by the company is currently kept in Turkey. In this regard, it is not possible to transfer your personal data abroad. However, if the Company decides to keep the personal data in question abroad, personal data may be transferred abroad for this purpose, to countries with adequate data protection rules or to countries where there are no sufficient data protection rules, provided that all necessary precautions are taken. The Company agrees to act in accordance with the Law at all times.

 

Article 6. Your Rights Regarding Your Personal Data

6.1. The rights of employees as data subjects in accordance with the law are as follows, without prejudice to the law to which the Company is subject and the obligations:

6.1.1. The right to learn whether your personal data is being processed or not and to request information regarding whether it is being processed,

6.1.2. The right to learn the purpose of processing and whether it is used for its intended purpose,

6.1.3. The right to know third parties to whom personal data is transferred,

6.1.4. The right to request correction in case it has been processed incompletely or incorrectly, the right to request notification of third parties to whom your personal data has been transferred if you exercise this right,

6.1.5. The right to request the deletion or destruction of your personal data, and the right to request notification of the situation to third parties to whom your personal data has been transferred if you exercise this right,

6.1.6. The right to object to the conclusion about you obtained through the analysis of data by automatic systems and to demand compensation in case you suffer damage.

7.1. When you want to exercise your rights or when you learn that there has been or is likely to be a violation, you can contact us using the contact information below.

7.2. When you notify us of any violation, the relevant unit of our Company will investigate the violation in question and inform you about the existence of the violation and its remediation within 3 (three) business days at the latest.

 

Article 8. Amendment

8.1. The information contained in this Internal Directive and Consent Declaration Form may be changed by the Company from time to time, in which case a notification may be sent to you stating that the Company’s data protection regulations have changed.

9.1. Company Personal Data Protection and Processing Policy

You can reach it at mtekbilisim.com. By signing this Internal Directive and Consent Form, you are submitting your declaration regarding compliance with MTEK BİLİŞİM SİSTEMLERİ VE DANIŞMANLIK HİZ.SAN.TİC.A.Ş KVKK POLICY.

9.2. By signing this Internal Directive and Consent Form, you expressly consent to the processing of your personal data and the following:

9.2.1. As your employer, the Company may keep, process and/or transfer your personal data – including your health data – to third parties and countries – including countries where adequate protection is not provided,

9.2.2. Employee personal data held by the employer will continue to be processed until the termination of the employment contract and, in any case, until the reasons requiring the processing of personal data disappear,

9.2.3. The Company has the authority to review the personal data obtained through devices such as phones, computers and cars allocated to employees, for its legitimate purposes.

Article 10. Enforcement

10.1. This Internal Directive was put into effect by the Company on 29.02.2024.
